SUBJECT: Illinois SB 99
During the
General Assembly Session of 2004, the IWFA requested input regarding
an amendment to allow film on the front side windows. The State
Police again
indicated they were opposed to this measure; and after working with
Senator
Sullivan, it was determined that the IWFA would not initiate a
legislative
amendment.
This year
there has been legislation introduced in the form of Senate Bill
99. Senator Larry K. Bomke, Senate Minority Spokesperson, introduced
the legislation. The legislation
amends provisions of the Illinois Vehicle Code related to the
medical exemption. The
legislation eliminates a prohibition against applying tinting on or
after January 1,
1998; eliminates a precipitation against tinting for medical
purposes on or after
January 1, 2008; and makes other conforming changes. The proposed
legislation also pro-
vides that the Secretary of State shall (rather than may) notify law
enforcement
agencies if a physician’s certification has been issued.
The proposed
language is an enhancement to the current limits for a medical
exemption, but the industry should monitor the legislation as it
advances due to
past indications that this is an area of interest from enforcement.
