SUBJECT: House Bill 734 Passes Senate
The Senate
adopted House Bill 734 without any amendments. The legislation now
goes to the Governor for final approval and will become law on July
1, 2005. This legislation does not
have any tolerances, requires reflectivity testing, and esta-
blishes a fee of $5.00 for safety inspection. This legislation was
strongly endorsed
by the Highway Patrol and will be evaluated for one year to see what
implementa-
tion issues arise. This legislation is strongly opposed by the
window film industry.
IWFA will be
evaluating this legislation over the next several weeks and
developing
the most appropriate strategies for addressing the problems that
will be encountered
by our industry. Additional information will be shared with our
members as we
make every effort to provide the appropriate response to the
enactment of House
Bill 734.
It will be
necessary for every member to assist in this effort as we move
forward.
This will have an adverse impact on every citizen, our businesses,
and will create enforcement/legal problems for the state. We must
make every effort to amend the
current language in a manner that is consistent with good public
policy for the state
of Mississippi.
Please refer to the Legislative
Alert dated February 15, 2005 to review the effects
that this law will have. The Legislative Consultant asks that each
member contact the
IWFA to comment on any problems the new statutory requirements will
cause.
Over the next several weeks we will formulate a strategy for action
during the 2006 legislature.
